Overview

The COAG Legislation Amendment Act 2024 was enacted to address the cessation of the Council of Australian Governments (COAG), a significant intergovernmental forum in Australia. This Act was passed by the Parliament of Australia, comprising the Senate and the House of Representatives, and received Royal Assent on 5 July 2024. The primary objective of the Act is to ensure a smooth transition from COAG's existing framework by providing for related legislative amendments and necessary adjustments to maintain effective intergovernmental coordination and collaboration in Australia. The Act acknowledges the need to adapt to the changing landscape of federal governance and to ensure that the mechanisms for intergovernmental decision-making and policy implementation remain robust and effective.

Scope and Application

The COAG Legislation Amendment Act 2024 applies to the cessation of the Council of Australian Governments (COAG) and related entities, impacting all levels of government and relevant public servants involved in the operation of COAG. The geographic scope of this Act is national, affecting all states and territories within Australia. It outlines the process for the dissolution of COAG and the redistribution of its functions among state, territory, and federal governments, including any transitional arrangements necessary to ensure continuity in governance and policy implementation. There are no specific exclusions or exemptions outlined within the Act, though it may be subject to further clarification or adjustment through subordinate legislation. The Primary Industries (Customs) Charges Act 2024 applies to the imposition of charges on primary industries that are categorised as duties of customs, impacting producers, exporters, and importers within the primary industries sector. This Act has a national jurisdictional reach, applying uniformly across all states and territories. It provides a framework for the collection and management of these charges, ensuring compliance and proper administration. The Act may be further extended or restricted through subordinate instruments to clarify specific aspects of charge imposition and collection.

Key Provisions

The COAG Legislation Amendment Act 2024 (No. 54 of 2024) primarily addresses the cessation of the Council of Australian Governments (COAG). This Act outlines the necessary steps to formally dissolve COAG and provides for related administrative and transitional arrangements. The Act also includes provisions to ensure a smooth transition of responsibilities and functions previously managed by COAG to other entities or governmental bodies. The Primary Industries (Customs) Charges Act 2024 (No. 55 of 2024) establishes a framework for the imposition of primary industries charges that are classified as duties of customs. This Act specifies the types of charges that can be levied on certain primary industries, the procedures for their imposition, and the collection mechanisms. The Primary Industries (Excise) Levies Act 2024 (No. 56 of 2024) deals with the imposition of primary industries levies classified as duties of excise. This Act details the levies applicable to various primary industries, the criteria for their imposition, and the collection process. The Primary Industries (Services) Levies Act 2024 (No. 57 of 2024) focuses on the imposition of primary industries levies that do not fall under duties of customs or excise. This Act sets out the levies applicable to certain services within the primary industries sector, the conditions for their imposition, and the relevant collection procedures. These Acts impose specific obligations on primary industries, including compliance with the levies and charges imposed. They require industries to report and pay the specified levies and charges as outlined in the respective Acts. The Primary Industries Levies and Charges Collection Act 2024 (No. 58 of 2024) mandates the collection of levies and charges imposed under the Primary Industries (Excise) Levies Act 2024 and the Primary Industries (Services) Levies Act 2024, as well as charges imposed under the Primary Industries (Customs) Charges Act 2024. The Act details the collection processes, reporting requirements, and the entities responsible for collection. The Primary Industries Levies and Charges Disbursement Act 2024 (No. 59 of 2024) outlines the disbursement of collected levies and charges to the appropriate entities, ensuring that the funds are distributed according to the prescribed purposes. The Act specifies the entities eligible to receive the disbursed funds and the conditions under which disbursements are made. Failure to comply with the provisions of these Acts can result in civil and criminal penalties. For example, non-compliance with the levies and charges imposition and collection requirements can lead to fines and legal action. The maximum penalties for breaches of these Acts vary depending on the specific offence and the severity of the breach, but they can include substantial fines and potential imprisonment for serious offences. The Acts also provide for other civil and criminal consequences, such as the imposition of administrative penalties, the recovery of unpaid levies and charges, and the enforcement of compliance through the courts.
