Acts of Parliament assented to

 

It is hereby notified, for general information, that Her Excellency the Governor-General, in the name of Her Majesty, assented on 14 March 2013 to the undermentioned Act passed by the Senate and the House of Representatives in the Parliament assembled, viz.:

 

 No. 8 of 2013An Act to amend the law relating to finance, and for other purposes. (Financial Framework Legislation Amendment Act (No. 1) 2013).

 No. 9 of 2013An Act to amend the Marine Safety (Domestic Commercial Vessel) National Law Act 2012, and for related purposes. (Marine Safety (Domestic Commercial Vessel) National Law Amendment Act 2013).

 No. 10 of 2013—An Act to amend the law relating to migration, and for other purposes. (Migration Amendment (Reform of Employer Sanctions) Act 2013).

 No. 11 of 2013—An Act to amend the Offshore Petroleum and Greenhouse Gas Storage Act 2006, and for other purposes. (Offshore Petroleum and Greenhouse Gas Storage Amendment (Compliance Measures) Act 2013).

 No. 12 of 2013—An Act to encourage the loan of objects from overseas for temporary public exhibition in Australia, and for related purposes. (Protection of Cultural Objects on Loan Act 2013).

Overview

The Marine Safety (Domestic Commercial Vessel) National Law Amendment Act 2013 applies to domestic commercial vessels operating within Australian waters, aiming to enhance maritime safety by amending existing national laws. This Act also operates on a national level, ensuring uniform standards across states and territories. The Migration Amendment (Reform of Employer Sanctions) Act 2013 applies to employers within Australia, seeking to reform the sanctions regime for non-compliance with migration laws. Key Provisions

The Financial Framework Legislation Amendment Act (No. 1) 2013 (section 3) amends the Financial Framework (Financial and Fiscal Framework) Act 2009 to allow for the setting of the aggregate limit on the amount of the Commonwealth's net debt and the aggregate limit on the amount of the Commonwealth's net foreign liabilities. Section 3 of the Act provides that these limits are to be set by the Minister for Finance by legislative instrument. The Marine Safety (Domestic Commercial Vessel) National Law Amendment Act 2013 (section 3) amends the Marine Safety (Domestic Commercial Vessel) National Law Act 2012 to include new requirements for the certification of domestic commercial vessels. Section 3 of this Act specifies that vessels over a certain size must be certified by a recognised certifying authority, and the certification must be renewed every five years. The Protection of Cultural Objects on Loan Act 2013 (section 6) aims to facilitate the loan of cultural objects from overseas for exhibition in Australia. Section 6 outlines the conditions under which such loans can be made, including the requirement for insurance coverage and the establishment of a loan agreement between the lender and the borrower. Finally, the Federal Circuit Court of Australia (Consequential Amendments) Act 2013 (section 7) makes amendments to various Acts to reflect changes in the Federal Circuit Court of Australia Legislation Amendment Act 2012. Section 7 ensures that references to the Federal Circuit Court are updated in relevant legislation to maintain consistency. The obligations imposed by these Acts include compliance with the specified requirements for financial frameworks, vessel certification, employer sanctions, offshore operations, cultural object loans, and consequential amendments.
