Overview

The Infrastructure Australia Amendment Act 2014 was assented to by the Governor-General on 17 July 2014, marking a significant revision to the Infrastructure Australia Act 2008. This legislation was introduced to address the need for updates to the infrastructure planning framework, aiming to enhance the efficiency and effectiveness of infrastructure investment planning across Australia. The Act was passed by the Australian Parliament, reflecting a commitment to improving national infrastructure through more strategic and coordinated planning. The policy objective is to ensure that infrastructure investments better align with the long-term needs of the nation, thereby supporting economic growth and improving the quality of life for Australians. The Trade Support Loans Act 2014, also assented to on 17 July 2014, was designed to provide financial support to certain apprentices, addressing the gap in funding available for vocational training and development. This Act was introduced to bolster the apprenticeship system, which is crucial for developing skilled tradespeople and supporting economic growth through enhanced workforce capabilities. Passed by the Australian Parliament, the Act aims to provide necessary financial incentives to employers and apprentices, ensuring that more Australians can access quality vocational training and thereby benefit from the economic and social advantages of a skilled workforce.

Scope and Application

The series of Acts passed by the Commonwealth Parliament in 2014 cover a broad range of legislative reforms, impacting various sectors and regulatory frameworks. The Infrastructure Australia Amendment Act 2014 modifies the Infrastructure Australia Act 2008, affecting entities involved in infrastructure projects and funding. The Health Insurance Amendment (Extended Medicare Safety Net) Act 2014 alters the Health Insurance Act 1973, influencing health insurance providers and beneficiaries. The Offshore Petroleum and Greenhouse Gas Storage Amendment Acts 2014 adjust the regulatory landscape for offshore petroleum and greenhouse gas storage activities, impacting companies and operators in these industries. The Trade Support Loans Acts 2014 introduce trade support loans for apprentices, with the Consequential Amendments Act addressing related legal changes. The Clean Energy Legislation (Carbon Tax Repeal) Act 2014 and its associated Acts eliminate the carbon tax, affecting industries reliant on fossil fuels. The Customs Tariff and Excise Tariff Amendment Acts 2014, along with the Ozone Protection and Synthetic Greenhouse Gas Amendment Acts 2014, modify tariffs and levies related to carbon and synthetic greenhouse gases. The Agricultural and Veterinary Chemicals Legislation Amendment Act 2014 simplifies chemical approvals, while the Regulatory Powers (Standard Provisions) Act 2014 standardises regulatory powers across agencies. These Acts apply nationally, affecting entities and individuals within Australia, unless otherwise specified by individual Acts.

Key Provisions

The Infrastructure Australia Amendment Act 2014 (No. 77 of 2014) amends the Infrastructure Australia Act 2008 (Cth) to enhance the operations of Infrastructure Australia, focusing on improving the quality and efficiency of infrastructure planning and reporting. This Act also introduces changes to the membership of the Infrastructure Australia Board and provides for a more rigorous process for reviewing the Board's performance. The Health Insurance Amendment (Extended Medicare Safety Net) Act 2014 (No. 78 of 2014) amends the Health Insurance Act 1973 (Cth) to extend the Medicare Safety Net, allowing patients to claim a higher percentage of their out-of-pocket expenses. The Offshore Petroleum and Greenhouse Gas Storage (Regulatory Levies) Amendment Act 2014 (No. 79 of 2014) amends the Offshore Petroleum and Greenhouse Gas Storage (Regulatory Levies) Act 2003 (Cth) to adjust the levies imposed on offshore petroleum and greenhouse gas storage activities. This Act aims to ensure that the levies continue to provide necessary funding for regulatory activities while remaining fair to industry participants. The Offshore Petroleum and Greenhouse Gas Storage Amendment (Regulatory Powers and Other Measures) Act 2014 (No. 80 of 2014) amends the Offshore Petroleum and Greenhouse Gas Storage Act 2006 (Cth) to strengthen regulatory powers and introduce new measures for ensuring compliance with safety and environmental standards. These Acts impose various obligations on the parties and entities they govern. Infrastructure Australia is required to submit annual reports to the government and make recommendations on infrastructure priorities. The amended Health Insurance Act requires health insurers to comply with the new safety net provisions, ensuring they process claims according to the updated thresholds. The Offshore Petroleum and Greenhouse Gas Storage Acts impose obligations on operators to pay the revised regulatory levies and adhere to enhanced safety and environmental standards. The Trade Support Loans Act 2014 (No. 81 of 2014) and Trade Support Loans (Consequential Amendments) Act 2014 (No. 82 of 2014) establish a framework for providing loans to apprentices, with obligations on both the government and apprentices to ensure proper use and repayment of the loans. The Clean Energy Legislation (Carbon Tax Repeal) Act 2014 (No. 83 of 2014) repeals the Clean Energy Act 2011 (Cth), eliminating the carbon tax and associated obligations. The Acts also outline various offences, penalties, and consequences for non-compliance. Under the Regulatory Powers (Standard Provisions) Act 2014 (No. 93 of 2014), regulatory agencies are granted enhanced powers to investigate, monitor, and enforce compliance with relevant laws. Non-compliance with these Acts may result in administrative penalties, including fines and legal action. For example, failure to comply with safety and environmental standards in the offshore petroleum and greenhouse gas storage sectors could result in significant financial penalties, as well as potential criminal charges for serious breaches. The maximum penalties vary depending on the specific offence and the Act under which it is committed, but they are intended to ensure strict adherence to the regulatory requirements and protect public and environmental interests.
