Overview

The Timor Sea Maritime Boundaries Treaty Consequential Amendments Act 2019 was enacted to address issues related to the maritime boundaries in the Timor Sea between Australia and Timor-Leste. This Act was introduced to amend existing laws in order to implement the provisions of the Timor Sea Maritime Boundaries Treaty, which was signed to resolve long-standing disputes over maritime boundaries, particularly in relation to the exploitation of natural resources such as oil and gas. The enactment of this legislation was necessary to ensure that Australia's legal framework is aligned with the terms of the Treaty, thereby providing certainty and stability for all parties involved. The policy objective of the Act is to facilitate the effective management and regulation of maritime boundaries, ensuring that Australia can continue to exploit its maritime resources while maintaining good relations with Timor-Leste. The Act was assented to by the Governor-General on 7 August 2019 following its passage through both the Senate and the House of Representatives in the Australian Parliament.

Scope and Application

The Timor Sea Maritime Boundaries Treaty Consequential Amendments Act 2019 applies to the delineation of maritime boundaries in the Timor Sea between Australia and East Timor, amending existing laws to reflect the terms of the Treaty on Certain Maritime Arrangements in the Timor Sea. The Act primarily affects government entities, including the Commonwealth, the states, and the territories, and potentially any private entities engaged in maritime activities within the newly defined boundaries. The geographic reach of the Act is confined to the maritime areas specified in the Treaty, extending to the borders as agreed between Australia and East Timor. There are no specific exclusions or exemptions mentioned in the Act itself, but it is likely that other legislative instruments will provide further detail on how the Act applies in practice. The Act’s scope may be further extended or restricted through subordinate legislation, such as regulations or administrative guidelines, which may define more specific operational parameters for the amended maritime boundaries. The Passenger Movement Charge Amendment (Timor Sea Maritime Boundaries Treaty) Act 2019 amends the Passenger Movement Charge Act 1978 to ensure the collection of passenger movement charges in accordance with the new maritime boundaries set out in the Timor Sea Maritime Boundaries Treaty. This Act applies to all airlines, shipping companies, and other entities responsible for transporting passengers who enter or leave Australia via the maritime boundaries affected by the Treaty. The jurisdictional reach of the Act is confined to the maritime zones that are subject to the new boundary arrangements, and it does not specify any exclusions or exemptions. Like the previous Act, the application and enforcement of this Act may be further detailed in subordinate instruments, which could include regulations outlining the precise methods and locations for the collection of charges.
