It is hereby notified, for general information, that Her Excellency the Administrator, in the name of His Majesty, assented on 23 June 2023 to the undermentioned Acts passed by the Senate and the House of Representatives in the Parliament assembled, viz.:
No. 24 of 2023—An Act to establish Creative Australia, and for related purposes. (Creative Australia Act 2023).
No. 25 of 2023—An Act to deal with consequential and transitional matters arising from the enactment of the Creative Australia Act 2023, and for related purposes. (Creative Australia (Consequential and Transitional Provisions) Act 2023).
No. 26 of 2023—An Act to amend the Migration Act 1958, and for related purposes. (Migration Amendment (Giving Documents and Other Measures) Act 2023).
No. 27 of 2023—An Act to amend the law relating to child support, and for related purposes. (Social Services Legislation Amendment (Child Support Measures) Act 2023).
No. 28 of 2023—An Act to amend the law relating to taxation and housing, and to amend the Commonwealth Banks Act 1959, and for related purposes. (Treasury Laws Amendment (2023 Measures No. 2) Act 2023).

Overview
The Creative Australia Act 2023, assented to by Her Excellency the Administrator on 23 June 2023, was enacted to establish a new entity, Creative Australia, aimed at fostering and supporting the arts and cultural sector across the nation. Complementing this, the Creative Australia (Consequential and Transitional Provisions) Act 2023 was also passed to manage any transitional and consequential matters arising from the establishment of Creative Australia.
The Migration Amendment (Giving Documents and Other Measures) Act 2023, the Social Services Legislation Amendment (Child Support Measures) Act 2023, the Treasury Laws Amendment (2023 Measures No. 2) Act 2023, and the Treasury Laws Amendment (2022 Measures No. 4) Act 2023 were also assented to on the same day, addressing various aspects of migration, child support, taxation, housing, superannuation, and the Clean Energy Finance Corporation. These Acts aim to refine and enhance the legal frameworks governing these areas, ensuring they are up-to-date with current needs and policy directions.
Scope and Application
The Creative Australia Act 2023 applies to individuals and entities involved in the creative and cultural sectors within Australia. This encompasses a broad range of activities including, but not limited to, the production, dissemination, and preservation of cultural and creative works. The Act aims to foster and support the creative industries, including visual arts, performing arts, literature, and cultural heritage. It is applicable across the Commonwealth of Australia and extends to all states and territories, thereby providing a unified framework for the development and support of creative endeavours nationwide. The Act does not explicitly state exclusions or exemptions, suggesting a broad application unless specified in subordinate legislation or regulations. The Act also incorporates transitional and consequential provisions as detailed in the Creative Australia (Consequential and Transitional Provisions) Act 2023, which ensures a smooth implementation and integration of the new legislative framework with existing laws.
Key Provisions
The Creative Australia Act 2023 (section 2) establishes Creative Australia, a new entity tasked with promoting and supporting the creative industries in Australia. The Creative Australia (Consequential and Transitional Provisions) Act 2023 (section 3) deals with the transitional measures necessary to implement the Creative Australia Act 2023. This includes the transfer of functions, staff, and assets from existing agencies to Creative Australia (section 5). It also provides for the repeal of certain existing legislation that is no longer relevant following the establishment of Creative Australia (section 6). Furthermore, this Act ensures that any ongoing projects or initiatives are smoothly transitioned to the new entity without disruption (section 7).
The Migration Amendment (Giving Documents and Other Measures) Act 2023 (section 3) introduces changes to the Migration Act 1958, focusing on the issuance and management of travel documents for Australian citizens and visa holders. This Act requires the Minister for Home Affairs to issue Australian travel documents to eligible individuals who do not hold an Australian passport (section 4). It also mandates the implementation of measures to prevent the misuse of travel documents and strengthen the security of the visa system (section 5).
