It is hereby notified, for general information, that Her Excellency the Governor-General, in the name of Her Majesty, assented to the undermentioned Acts passed by the Senate and the House of Representatives in the Parliament assembled, viz.:

 

Assented to on 17 November 2012:

 No. 154 of 2012—An Act to amend the law relating to family assistance, social security, child support, paid parental leave and Indigenous education, and for related purposes. (Social Security and Other Legislation Amendment (Further 2012 Budget and Other Measures) Act 2012).

 No. 155 of 2012—An Act to change the law relating to securities issued by the Commonwealth and beneficial interests in such securities, and for related purposes. (Commonwealth Government Securities Legislation Amendment (Retail Trading) Act 2012).

 No. 156 of 2012—An Act to amend the law relating to higher education, vocational education and training and research funding, and for related purposes. (Higher Education Support Amendment (Maximum Payment Amounts and Other Measures) Act 2012).

Overview

The Social Security and Other Legislation Amendment (Further 2012 Budget and Other Measures) Act 2012 was assented to by the Governor-General on 17 November 2012. Section 2 of the Act increases the maximum payment amounts for Higher Education Loan Program (HELP) debts, reducing the financial burden on students. Section 3 modifies the eligibility criteria for vocational education and training funding, making it more inclusive. Under these Acts, various offences, penalties, or civil/criminal consequences apply for non-compliance. For example, the Social Security and Other Legislation Amendment Act includes provisions for civil penalties for incorrect claims or fraudulent activities, with penalties that can reach up to $11,000 for individuals and $55,000 for corporations (section 15). The Commonwealth Government Securities Legislation Amendment Act imposes both civil and criminal penalties for non-compliance, including fines of up to $504,000 for corporations and imprisonment for up to five years for individuals (section 8). Similarly, the Higher Education Support Amendment Act outlines penalties for non-compliance with funding regulations, which can include financial penalties and legal action to recover misappropriated funds (section 12).
