The scope of the Act extends nationally, covering the entire Commonwealth of Australia, including its territorial waters and the Australian Exclusive Economic Zone. The Act mandates that certain actions, such as those that may significantly impact listed threatened species, communities, or migratory species, require formal approval. For instance, Pilbara Logistics Western Australia (PLWA) Group must develop a quarry operation for extracting gravel, sand, and pindan material, subject to an accredited assessment process as an Environmental Impact Statement under the NSW Environmental Planning and Assessment Act 1979 (reference 2012/6636). Breaches of the EPBC Act can result in both civil and criminal penalties. Civil penalties for contravening the Act include fines of up to $666,000 for individuals and $3.3 million for corporations, as stipulated in section 528.
