Scope and Application

These matters include World Heritage properties, national heritage places, wetlands of international importance, listed threatened species and ecological communities, and water resources. The Act has a national jurisdictional reach, governing activities across all states and territories of Australia, as well as in Commonwealth marine areas. The Act may also apply to activities occurring outside Australia if they impact on matters of national environmental significance. The application of the Act can be extended or restricted through subordinate legislation and regulations, which provide further detail on the types of activities and thresholds that require approval. Certain activities are exempt from the requirements of the Act if they are carried out in a specific manner, as outlined in the Act and accompanying regulations. Key Provisions

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) governs the protection of the environment, particularly concerning actions that may have a significant impact on matters of national environmental significance. Section 75 of the EPBC Act identifies certain actions that require approval, while section 87 deals with the assessment approach for these actions. Section 133 pertains to the approval of actions, and section 143 concerns variations of the conditions of approval. Additionally, section 130(4) allows for the extension of time for the assessment of actions. Under the EPBC Act, actions that may significantly impact matters of national environmental significance, such as listed threatened species and communities, water resources in relation to coal seam gas development and large coal mining development, World Heritage, and National Heritage, require approval (sections 18, 18A, 24D, 24E, 12, 15A, 15B, and 15C). The Department of the Environment has a responsibility to ensure that notifications relating to the processing of referrals for approval under Chapter 4 of the EPBC Act are made within the required timeframes. In cases where notifications are missed or not met, the Department has implemented systems and ongoing quality assurance procedures to minimise any risk of missing a notification within the required timeframe (section 130(4)). Breach of the EPBC Act may result in civil or criminal consequences, depending on the nature and severity of the offence. Civil penalties may include fines of up to $66,000 for individuals and $330,000 for bodies corporate for each offence (section 514). Criminal penalties may include fines of up to $2.75 million for individuals and $13.75 million for bodies corporate, imprisonment for up to five years for individuals and ten years for bodies corporate, or both (section 515). In addition to these penalties, the court may order the offender to take specific actions to remedy the breach or prevent its recurrence (section 516).
