Overview

Scope and Application

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) applies to a broad range of actions that may have a significant impact on matters of national environmental significance, including listed threatened species and communities, wetlands of international importance, world heritage properties, and the environment associated with the Great Barrier Reef. This legislation governs various entities such as corporations, partnerships, unincorporated associations, and individuals, encompassing a wide array of industries and activities. It mandates that certain actions, which are identified as requiring approval, must undergo an assessment process to determine their potential environmental impacts. Key Provisions

The Department then assesses the application and decides whether the action requires approval, approval with conditions, or is not required. The Act also imposes obligations on proponents to provide information and documentation to support their application, including preliminary documentation, as outlined in Section 87 of the Act. The Act allows for the variation of conditions of approval under Section 143, which can be useful in managing environmental risks and impacts over the life of a project. The Act also provides for the extension of time for decision-making on approval under Section 130(4), which can be useful in managing complex or high-risk projects. The EPBC Act provides for both civil and criminal penalties for breaches of the Act. Section 536 of the Act provides for fines of up to AUD 666,666 for individuals and AUD 3,333,300 for bodies corporate for breaches of the Act. Section 537 of the Act provides for imprisonment for up to three years for individuals and five years for bodies corporate for serious or repeated breaches of the Act. The Act also provides for the recovery of costs incurred by the Department in assessing an approval application under Section 540. The Act includes provisions for the enforcement of its provisions, including the power of entry and investigation by authorised officers under Section 556. The Act also provides for the referral of matters to the Australian Federal Police or other law enforcement agencies where criminal activity is suspected.
