Overview

Scope and Application

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) applies to a broad range of entities, including individuals, corporations, and government agencies, with respect to actions that may impact matters of national environmental significance. The Act covers various industries such as mining, commercial and residential developments, transport infrastructure, and waste management, among others. It imposes obligations on entities to avoid, mitigate, or offset the impacts of their actions on listed threatened species, ecological communities, and heritage places. The jurisdictional reach of the Act is national, with the Commonwealth having the authority to regulate actions that may significantly affect matters of national environmental significance. The EPBC Act may extend or restrict its application through subordinate instruments, such as regulations or guidelines, which provide further detail on specific requirements or exemptions. Key Provisions
