It applies to both Commonwealth and state jurisdictions, and its reach extends to all territories and states within Australia. The Act provides for the approval, assessment, and monitoring of specified actions that may impact national environmental assets such as listed threatened species and communities, migratory species, World Heritage properties, and the Great Barrier Reef Marine Park. Certain actions may be exempt from approval requirements if they are determined not to require such approval under the Act. Key Provisions

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) governs the approval process for actions that may impact matters of national environmental significance. Section 75 of the Act identifies actions that require approval, including those that may affect listed threatened species and communities (sections 18 & 18A), listed migratory species (sections 20 & 20A), World Heritage properties (sections 12 & 15A), and the Great Barrier Reef Marine Park (sections 24B & 24C), among others. The Act also outlines actions determined as not requiring approval under section 75, such as certain mining and residential developments. The Act imposes obligations on parties or entities seeking approval for actions that may impact matters of national environmental significance. This includes providing detailed information about the proposed action, its potential environmental effects, and measures to mitigate any adverse impacts. The Minister for the Environment must consider the public interest in the proposed action and the potential environmental impacts when deciding whether to approve the action. For example, section 528 of the Act provides that a person who contravenes a condition of an approval is liable to a penalty of up to $666,666 for a corporation or $133,333 for an individual. Section 532 of the Act provides that a person who commits a criminal offence under the Act is liable to a penalty of up to $666,666 for a corporation or $133,333 for an individual. In addition, section 534 of the Act provides that a person who engages in conduct that constitutes a breach of a condition of approval may be subject to an injunction or other court order. The Act also provides for the variation of conditions of approval under section 143. This allows the Minister to vary the conditions of an approval if it is necessary to do so in the interests of the environment or to address a change in circumstances. The Act provides that the Minister must give notice of the variation to the person who holds the approval and to any other person who may be affected by the variation. The Minister must also publish a notice of the variation in the Gazette and on the Department of the Environment's website. Finally, the Act provides for the extension of time for the processing of referrals for approval under section 130(4). This allows the Minister to extend the time for processing a referral if it is necessary to do so in the interests of the environment or to allow for further consultation with relevant parties. The Act provides that the Minister must give notice of the extension to the person who made the referral and to any other person who may be affected by the extension. The Minister must also publish a notice of the extension in the Gazette and on the Department of the Environment's website.
