However, there are some exclusions and exemptions, such as actions that are already regulated under other Commonwealth or state legislation. Key Provisions

The Environment Protection and Biodiversity Conservation Act 1999 (the "EPBC Act") provides for the protection of the environment, particularly the conservation of biodiversity, through the regulation of actions that may impact on matters of national environmental significance. Section 75 of the Act specifies actions that require approval under the Act, such as actions that may significantly impact on listed threatened species and communities (sections 18 and 18A), listed migratory species (sections 20 and 20A), and Commonwealth marine areas (sections 23 and 24A). For example, section 474 of the Act provides for a maximum penalty of $66,000 for individuals and $330,000 for bodies corporate for failure to comply with an approval or a condition of an approval. Section 476 of the Act provides for a maximum penalty of $6,600 for individuals and $33,000 for bodies corporate for failure to comply with a requirement to prepare and provide documentation to the Department. The Act also provides for the variation of conditions of approval under section 143, and the extension of time for the making of decisions under section 130(4). The Department of Sustainability, Environment, Water, Population and Communities has implemented systems and ongoing quality assurance procedures to minimise any risk of missing a notification within the required timeframe, and will notify the public of any missed notifications even though the timeframe for notification has lapsed.
