The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) governs various actions that may impact the environment. Certain actions are designated as controlled actions under sections 18, 18A, 20, 20A, 21, 22A, 23, and 24A of the Act. These sections require proponents of specific projects to seek approval from the Minister for the Environment before proceeding. For example, the Metro Mining/Mining/West Cape York/QLD/Open cut bauxite mine and barging/transshipment operation on the western coastline of Cape York, Queensland (2015/7538) required approval due to its potential impact on listed threatened species and communities and Commonwealth marine areas. Conversely, the Pilbean Drive Mount Archer natural disaster road repair works, QLD (2015/7545) was determined not to require approval as it did not pose a significant risk to the environment. Proponents of controlled actions must comply with specific obligations set forth in the EPBC Act. They are required to submit detailed documentation outlining the potential environmental impacts of their proposed action and any measures they intend to implement to mitigate these impacts. For instance, the Department of Transport and Main Roads for the Eton Range Realignment, Peak Downs Hwy, QLD (2015/7552) needed to provide preliminary documentation and a thorough assessment of how the project would affect listed threatened species and communities. Furthermore, proponents must engage with relevant stakeholders, including Indigenous groups and local communities, to ensure their concerns and interests are considered in the decision-making process. The EPBC Act imposes penalties for non-compliance with its provisions. Section 535 of the Act stipulates that any person who contravenes the Act or its regulations may be subject to substantial fines. For example, if a proponent fails to obtain the necessary approval for a controlled action, they could be liable for a penalty of up to $660,000 for a corporation and $132,000 for an individual. Additionally, in cases where environmental harm occurs as a result of non-compliance, the responsible party may be required to undertake remediation measures and compensate affected parties. The severity of the penalty often depends on the degree of harm caused and the intent behind the contravention. In certain circumstances, the Minister may vary the conditions of approval for a controlled action. This power is outlined in section 143 of the EPBC Act. Similarly, the Upgrading the Pacific Highway - Woolgoolga to Ballina Upgrade, NSW (2012/6394) had its conditions varied on 16/09/2015. These variations can be made to address new information, changes in circumstances, or to ensure better environmental outcomes. The decision to vary conditions is made in consultation with relevant stakeholders and takes into account the potential environmental impacts of the proposed changes.
