While the Department has implemented systems and procedures to minimise the risk of missed notifications, it acknowledges that occasional missed notifications may occur, and it commits to notifying the public of any such missed notifications, even if they are outside the required timeframe.

Scope and Application

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) applies to a wide range of activities, entities, and industries within Australia, including both Commonwealth and non-Commonwealth activities. This Act governs the protection of the environment, particularly focusing on matters of national environmental significance, such as listed threatened species and ecological communities. The EPBC Act applies to actions that require approval, as well as those that do not, and includes various sectors such as residential and commercial developments, waste management, and energy generation. Its jurisdictional reach is nationwide, impacting both federal and state-regulated activities. The Act can extend or restrict its application through subordinate instruments, ensuring that the protection of the environment is maintained in accordance with national and international standards. Key Provisions

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) outlines the requirements for the approval of certain actions that may impact the environment. Section 75 of the Act provides that some actions require approval, while others do not. For example, residential developments in Brabham, Western Australia, and Canungra, Queensland, require approval under sections 18 and 18A as they may impact listed threatened species and communities (EPBC Act s.75). Offences under the Act may result in civil or criminal penalties, with maximum penalties varying depending on the nature and severity of the offence. The Act stipulates that notices of extension of time, such as the 10 business day extension for the Gorgon Gas Development 4th Train Proposal by Chevron Australia Pty Ltd, are provided to ensure compliance with the required timeframes. In the event of missed notifications, the Department of the Environment has implemented quality assurance procedures to rectify these oversights and ensure transparency in the referral and assessment process.
