Overview

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) was enacted to provide for the protection of the environment, particularly matters of national environmental significance, through the regulation of actions that may have a significant impact on the environment. The Act was introduced to address the gap in environmental protection that existed at the federal level, particularly in relation to the conservation of biodiversity and the management of environmental impacts of developments. The EPBC Act is administered by the Commonwealth Parliament and aims to achieve a balanced and nationally consistent approach to environmental protection. The Department of Agriculture, Water and the Environment is responsible for the administration of the EPBC Act, and ensures compliance with the Act through the regulation of actions that may have a significant impact on the environment. The department also implements quality assurance procedures to minimise the risk of missed notifications and ensures that any missed notifications are communicated to the public, even if the timeframe for notification has lapsed. The policy objective of the EPBC Act is to protect and conserve Australia's biodiversity and environment, while also promoting sustainable development and economic growth.

Scope and Application

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) applies to any actions that are declared to be 'controlled actions' under the Act, and which may have a significant impact on matters of national environmental significance. These matters include World Heritage properties, listed threatened species and ecological communities, listed migratory species, the marine environment, the Great Barrier Reef Marine Park, the waters of the Commonwealth, and the Antarctic. The Act applies to both individuals and entities, including corporations, government departments, and local councils, across all states and territories in Australia, as well as external territories. However, the Act does not apply to actions that are specifically excluded under the Act, such as certain activities related to national security, defence, or certain activities on Aboriginal land. The Act may also be extended or restricted through subordinate instruments such as regulations or guidelines. The Act provides for a range of assessment and approval processes, including referral to the Minister for the Environment, public notifications, and the preparation of assessment reports.

Key Provisions

The Environment Protection and Biodiversity Conservation Act 1999 (the "EPBC Act") governs the protection of the environment, particularly concerning actions that may impact listed threatened species and communities, listed migratory species, and other environmental elements of national or international significance. Section 75 of the EPBC Act requires that certain actions are assessed for their potential environmental impacts, and in some cases, these actions may require formal approval (sections 132 and 133). Conversely, section 75 also allows the Minister to determine that certain actions do not require approval if they are unlikely to have a significant impact on protected matters (section 75). For instance, in 2020, it was determined that the "Monaro Highway - Lanyon Drive Upgrade Package 1B, Hume, ACT" by Transport Canberra and City Services did not require approval (EPBC Act s.75). Under the EPBC Act, parties or entities involved in actions that require approval must adhere to stringent assessment and compliance protocols. These include submitting detailed environmental impact assessments and management plans, engaging in public consultations, and complying with any conditions set forth in the approval decision (sections 132, 133, and 143). For example, the "Karara Wind Farm Project, QLD" by CleanCo Queensland Limited was approved with specific conditions that must be followed to mitigate its environmental impact. Failure to comply with the requirements of the EPBC Act can result in significant legal consequences. Breaches of the Act may lead to enforcement actions by the Department of Agriculture, Water and the Environment, including fines, penalties, or even criminal charges (sections 535 and 536). The maximum penalties can vary significantly depending on the nature and severity of the breach. For example, individuals found guilty of contravening the EPBC Act can face fines of up to AUD 66,000 or imprisonment for up to two years, while corporations can face fines of up to AUD 330,000. Furthermore, ongoing non-compliance or repeated offences can lead to more severe penalties and long-term reputational damage. The EPBC Act thus imposes a substantial obligation on entities to ensure full compliance with its provisions to avoid these serious repercussions.
