It also applies to actions taken outside Australia if they impact on matters of national environmental significance. The Act includes specific exemptions, such as actions that are subject to other Commonwealth or state/territory legislation that adequately protects the matters of national environmental significance. Key Provisions

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) outlines specific provisions for the protection of the environment and biodiversity in Australia. Section 528A of the Act provides for the imposition of criminal penalties for serious and repeated breaches of the Act, including fines of up to $6,660,000 for individuals and $33,300,000 for bodies corporate, and imprisonment for up to five years for individuals and ten years for bodies corporate. The Act also provides for the imposition of penalties for failure to comply with assessment or approval requirements, as outlined in section 483A. These penalties may include fines of up to $66,600 for individuals and $333,000 for bodies corporate.
