Overview

Scope and Application

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) applies to a range of actions, entities, and projects that may impact on matters of national environmental significance, including listed threatened species and communities, water resources in relation to coal seam gas development and large coal mining operations, and Commonwealth land. This Act is administered by the Department of the Environment and its jurisdictional reach extends across the Commonwealth of Australia. Certain actions may require approval under the EPBC Act if they are deemed to have a significant impact on matters of national environmental significance. The Act allows for the approval process to include preliminary documentation assessments, conditions on approval, and variations to the conditions of approval. Entities and projects subject to the EPBC Act include mining operations, residential and commercial developments, energy generation and supply projects, and transport land developments, among others. The Act also provides for the extension of time for the assessment and approval of certain actions. The EPBC Act may be extended or restricted in application through subordinate instruments, such as regulations and codes of practice. However, it is noted that late notifications do not affect the subsequent processing of referrals or assessments, nor do they impact on decisions made under the Act.

Additionally, the Act allows for the recovery of costs associated with the enforcement of the Act. The Act provides for the extension of time for certain approvals (section 130(4)), which can be particularly relevant in cases where additional information is required or where parties need more time to prepare comprehensive documentation. The Department of the Environment has implemented quality assurance procedures to minimise missed notifications, ensuring transparency and public access to information regarding environmental approvals and assessments.
