Scope and Application

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) applies to actions that may significantly impact matters of national environmental significance, as specified in the Act. These matters include World Heritage properties, national heritage places, wetlands of international significance (Ramsar wetlands), listed threatened species and communities, the Great Barrier Reef, nuclear actions, and Commonwealth land and waters. The Act applies to both individuals and entities engaged in various activities such as mining, residential and commercial development, transport infrastructure, and manufacturing, among others, that may affect these environmental matters. The jurisdictional reach of the EPBC Act is national, extending across all states and territories of Australia, as well as Commonwealth lands and waters.
