The EPBC Act covers various industries, such as mining, energy generation and supply, waste management, and commercial and residential developments. The Act also extends its reach to actions occurring outside Australia's territory if they impact on matters of national environmental significance. The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) governs the protection of the environment and biodiversity in Australia. Under this Act, certain actions are designated as requiring approval, which means that they cannot proceed unless the Minister for the Environment has granted approval. Actions that require approval include those that may have a significant impact on matters of national environmental significance (NES), such as listed threatened species and communities, listed migratory species, and wetlands of international importance (sections 18, 18A, 20, 20A, and 16 of the EPBC Act). For instance, Gunnedah Gravel Products Pty Ltd's Mary's Mount Blue Metal Quarry Expansion in NSW, and New Hope Collieries Pty Ltd's Chuwar Project mine rehabilitation activities in Queensland, both required approval due to potential impacts on listed threatened species and communities and listed migratory species (sections 18, 18A, 20, and 20A). Entities or individuals proposing actions that require approval must submit a referral to the Minister for assessment and approval. The Minister may grant approval with conditions to mitigate any potential adverse environmental impacts. For example, Australia Pacific LNG CSG Transmission Pty Limited's Ruby Spur Line project in Queensland and Fortescue Metals Group Limited's Expansion of Cloudbreak iron ore mine in Western Australia were both approved with conditions (sections 133 and 143 of the EPBC Act). Additionally, the Act imposes obligations on the parties to provide necessary information and documentation to support their referral and to comply with any conditions imposed by the Minister. The maximum penalties vary depending on the nature and severity of the offence. For example, knowingly or recklessly causing harm to a listed threatened species or community can result in a fine of up to AUD 66,000 or imprisonment for up to one year, or both (section 342 of the EPBC Act). Similarly, contravening a condition of approval can result in a fine of up to AUD 66,000 or imprisonment for up to six months, or both (section 474 of the EPBC Act). It is important for entities and individuals to be aware of their obligations under the EPBC Act and to take all necessary steps to comply with the Act and avoid any potential penalties or consequences.
