The Act covers a wide range of industries, conduct, and transactions across Australia, including mining, residential development, energy generation, and supply. The geographic reach of the Act is national, as it applies throughout Australia, including Commonwealth, state, and territory jurisdictions. The Act also extends to Commonwealth waters, external territories, and the Australian Antarctic Territory. Certain actions may be exempt from the need for approval under the Act if they comply with specific conditions or if they are undertaken in a manner that ensures there will be no significant impact on matters of national environmental significance. The EPBC Act can also extend or restrict its application through subordinate instruments such as regulations and guidelines. For instance, the Act may specify particular actions that are not controlled actions provided they are undertaken in a particular manner.
