The Act applies to both individuals and entities, irrespective of the industry they belong to, as long as their actions fall within the scope of the EPBC Act. It has a national jurisdictional reach, meaning it applies throughout Australia, including the territories. However, certain actions may be excluded or exempted from the requirements of the EPBC Act based on specific criteria or thresholds, and the Act may be extended or restricted through subordinate legislation or regulations.

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) sets out the main provisions regarding the protection of the environment, including the approval process for actions that may impact on matters of national environmental significance (s.75).
