Some public notifications on the Internet and in the Gazette relating to the processing of referrals for approval under Chapter 4 of the Environment Protection and Biodiversity Conservation Act 1999 may occasionally be missed in processing by the Department of the Environment or may not meet timeframes for notification. The Department of the Environment has implemented systems and ongoing quality assurance procedures to minimise any risk of missing a notification within the required timeframe. Where a missed notification is identified the practice will be to notify these even though the timeframe for notification has lapsed. This will ensure that the history of notifications for each referral is available to the public. The Department of the Environment regrets any inconvenience that may be caused by a missed notification. Please note that late notifications have not affected subsequent processing of referrals or assessments and they do not affect decisions made.

Overview

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) was enacted to provide for the protection of the environment, particularly matters of national environmental significance, by regulating actions that may have a significant impact on the environment. The EPBC Act was introduced to address the need for a comprehensive framework that would facilitate the protection of the environment, including ecosystems, heritage, and biological diversity, and to ensure that environmental considerations are integrated into decision-making processes at both federal and state levels. The Act is administered by the Australian Government's Department of the Environment, and its policy objective is to achieve ecological sustainability through the protection of the environment from significant impacts arising from actions within or outside Australia. The EPBC Act aims to balance environmental protection with economic development by providing a mechanism for assessing and managing the environmental impacts of proposed actions.

Scope and Application

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) applies to actions that may have a significant impact on matters of national environmental significance, as defined in the Act. The Act governs the activities of both public and private entities, including corporations, individuals, and government agencies, and encompasses a wide range of industries such as mining, residential and commercial development, water management, transport, and tourism. The geographic reach of the Act is national, applying to actions across Australia, including the Commonwealth, states, and territories. Certain actions are exempt from the requirements of the Act, including those that are minor in nature or have already been assessed under other legislation. The Act also allows for the Minister to extend or restrict the application of the Act through subordinate instruments, such as regulations or codes of practice. The Act provides for a range of assessment approaches and decision-making processes, including preliminary documentation, referral to other agencies, and public consultation. In some cases, the Minister may approve an action with conditions or refuse approval altogether. The Act also provides for the variation of conditions of approval and the reconsideration of decisions.

Key Provisions

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) governs a range of actions that may require approval or have specific obligations placed upon them. Section 75 of the Act lists actions that are determined to require approval, such as the removal of heritage buildings at RAAF Base, Amberley, Qld (EPBC Act s.75) and the rural residential subdivision at Rosewood Drive, Moore Creek, NSW (EPBC Act s.18 & 18A). The Act also allows for the variation of conditions of approval, such as the changes made to the Phil's Creek Iron Ore Project in Western Australia (EPBC Act s.143). Civil and criminal penalties are available for non-compliance with the Act's provisions. For instance, the unauthorised clearing of vegetation for residential development in Tamworth, NSW, is subject to penalties under the Act (EPBC Act s.155). The maximum penalties for breaches can include substantial fines and, in some cases, imprisonment for serious violations. The Act also provides for the extension of time for certain actions, such as the construction of a South Deposit Tailing Storage Facility in Savage River, Tasmania (EPBC Act s.130(4)). This allows for additional time to address any issues or delays in the approval process without necessarily affecting the outcome of the referral.
