Some public notifications on the Internet and in the Gazette relating to the processing of referrals for approval under Chapter 4 of the Environment Protection and Biodiversity Conservation Act 1999 may occasionally be missed in processing by the Department of Agriculture, Water and the Environment or may not meet timeframes for notification. The Department of Agriculture, Water and the Environment has implemented systems and ongoing quality assurance procedures to minimise any risk of missing a notification within the required timeframe. Where a missed notification is identified the practice will be to notify these even though the timeframe for notification has lapsed. This will ensure that the history of notifications for each referral is available to the public. The Department of Agriculture, Water and the Environment regrets any inconvenience that may be caused by a missed notification. Please note that late notifications have not affected subsequent processing of referrals or assessments and they do not affect decisions made.

Scope and Application
The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) applies to a wide range of activities, entities, and industries within Australia, focusing on protecting the environment and managing biodiversity. The Act primarily applies to actions that may have a significant impact on matters of national environmental significance, including listed threatened species, communities, and ecological places. The legislation governs both Commonwealth and non-Commonwealth actions, extending its reach to encompass projects and activities that require federal approval, particularly those impacting protected areas or listed species. The Act's jurisdiction is national, affecting all states and territories, with specific application to actions that cross state boundaries or have a transboundary effect. Certain actions, such as minor modifications to existing infrastructure, may be exempt from the need for approval if they meet specific criteria outlined in the Act. The Act also provides for the creation of subordinate instruments to refine the application of the legislation, such as determining thresholds for assessing the significance of an action's environmental impact or setting specific conditions for project approvals. While the Act strives to ensure timely notification of referral processing, there may occasionally be instances of missed notifications, for which the Department of Agriculture, Water and the Environment has established protocols to address any lapses and maintain transparency in the referral process.
Key Provisions
The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) includes various sections that outline the requirements and processes for the approval of actions that may affect matters of national environmental significance. Section 75(1) of the Act requires the Minister to determine whether a proposed action needs approval (section 75(1)). This determination is based on whether the action is a 'controlled action'. Section 18 and 18A of the Act address the requirements for assessing listed threatened species and communities, which must be considered in the approval process. Section 87 outlines the assessment approach that should be used to evaluate the environmental impact of proposed actions. Once an assessment is complete, the Minister may approve an action under section 133, either with or without conditions. Section 143 allows for the variation of conditions of approval, enabling adjustments to be made in response to new information or changing circumstances. The Act also provides for reconsideration of approval decisions under section 78C, allowing for a review of decisions that may have been made in error or based on incomplete information.
Under the EPBC Act, parties or entities proposing actions that may affect matters of national environmental significance must comply with various obligations and requirements. They must provide preliminary documentation and other relevant information as required by the Act, including details about the potential impact on listed threatened species and communities. The assessment process requires a thorough evaluation of the environmental impacts of the proposed action, which may involve consultation with relevant stakeholders and experts. If approval is granted, parties must adhere to any conditions imposed by the Minister, which may include measures to mitigate or offset environmental harm. In cases where approval is not required, parties must still comply with any relevant obligations under the Act, such as reporting requirements or notification of changes to the approved action.
Failure to comply with the requirements of the EPBC Act may result in various consequences, including civil and criminal penalties. Section 137 of the Act outlines the potential penalties for non-compliance, which may include fines of up to AUD 1.1 million for corporations and AUD 220,000 for individuals, as well as imprisonment for up to five years. Section 138 provides for the imposition of infringement notices for lesser offences, with penalties of up to AUD 66,000 for corporations and AUD 13,200 for individuals. Section 139A allows for the referral of matters to the Australian Federal Police for criminal investigation and prosecution in cases of serious environmental harm. The Act also provides for the recovery of costs incurred by the Minister in assessing or approving actions, as well as the imposition of injunctions or other orders to prevent or remedy environmental harm.
