Some public notifications on the Internet and in the Gazette relating to the processing of referrals for approval under Chapter 4 of the Environment Protection and Biodiversity Conservation Act 1999 may occasionally be missed in processing by the Department of the Environment and Energy or may not meet timeframes for notification. The Department of the Environment and Energy has implemented systems and ongoing quality assurance procedures to minimise any risk of missing a notification within the required timeframe. Where a missed notification is identified the practice will be to notify these even though the timeframe for notification has lapsed. This will ensure that the history of notifications for each referral is available to the public. The Department of the Environment and Energy regrets any inconvenience that may be caused by a missed notification. Please note that late notifications have not affected subsequent processing of referrals or assessments and they do not affect decisions made.

 

Overview

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) was enacted to provide for the protection of the environment, particularly matters of national environmental significance, by regulating actions that may have a significant impact on the environment. The Act was introduced to address the need for a cohesive framework to protect Australia's biodiversity, heritage, and ecosystems from potentially harmful activities. Enacted by the Australian Parliament, the policy objective of the EPBC Act is to ensure that the environment is protected and conserved for future generations by regulating activities that may significantly impact the environment. The Act provides a mechanism for the assessment and approval of proposed actions that may affect matters of national environmental significance, such as listed threatened species, communities, and migratory species, and wetlands of international importance. The EPBC Act also allows for the reconsideration and variation of approval conditions to ensure that any potential environmental harm is mitigated effectively.

Scope and Application

The Environment Protection and Biodiversity Conservation Act 1999 applies to a broad range of entities and actions across Australia, aiming to protect and conserve the environment, particularly focusing on matters of national and international environmental significance. This Act applies to all persons and entities engaging in activities that may impact listed threatened species, ecological communities, and matters of national environmental significance, such as wetlands, migratory species, and the World Heritage. These include corporations, government bodies, and individuals, and it extends to activities taking place within Australian territory and its external territories, as well as offshore areas under Australia's jurisdiction. The Act also regulates activities that may significantly impact the environment overseas if initiated within Australia or by an Australian citizen or corporation. Certain actions are exempt from the Act's controls if they meet specified criteria, and the Act's application can be extended or restricted through subordinate legislation. Subordinate instruments further detail the scope and application of the Act by providing additional definitions, specific guidelines for assessment processes, and conditions for approval of controlled actions.

Key Provisions

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) outlines various provisions concerning actions that may impact the environment, particularly focusing on listed threatened species and communities, wetlands of international importance, and listed migratory species. Section 75 of the Act mandates that certain actions are deemed to require approval, while others do not. For instance, the Great Northern Highway, Muchea to Wubin Upgrade Stage 2-Walebing to Wubin project in Western Australia (reference 2016/7761) and the Edithvale and Bonbeach Level Crossing Removals in Victoria (reference 2017/7906) are actions that require approval as they may affect listed threatened species and communities or wetlands of international importance (sections 18, 16, and 17B respectively). Entities or individuals carrying out actions that require approval under the EPBC Act must comply with stringent requirements. This involves submitting detailed documentation that addresses potential environmental impacts and proposes mitigation measures. For example, the South Wambo underground coal mine extension project (reference 2016/7636) and the Goonyella Riverside Mine to South Walker Creek Mine Dragline Move (reference 2016/7788) were both approved with conditions to ensure that the projects minimise environmental harm.
