The Act operates at the Commonwealth level, meaning it has jurisdiction across Australia and applies to all entities, including corporations, individuals, and government bodies, involved in activities that fall within its scope. Certain activities may be exempt from the requirements of the Act if they meet specific thresholds or conditions, as determined by the Minister. The application and scope of the Act can be extended or modified through subordinate legislation and regulations, which provide further detail and clarify specific provisions of the primary Act. These instruments allow for the specification of additional matters of national environmental significance, prescribed processes, and other administrative details to facilitate the effective implementation of the Act.

Key Provisions

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) governs actions that have, will have, or might have a significant impact on matters of national environmental significance. Under Section 75, the Act determines which actions require approval. For example, Coogee Energy Pty Ltd’s proposed commercial development in Laverton North, Victoria, requires approval due to its potential impact on listed threatened species and communities (sections 18 and 18A). Similarly, the proposed coal mining operations by Moolarben Coal Operations Pty Ltd in New South Wales also require approval for the same reasons. Conversely, actions such as the South Coast Highway upgrade by Main Roads Western Australia and residential developments in Western Australia do not require approval (EPBC Act s.75). Section 87 outlines the assessment approach for actions requiring approval, which involves preliminary documentation, such as the assessments for Coogee Energy Pty Ltd, Moolarben Coal Operations Pty Ltd, and Eyre Iron Pty Ltd. The EPBC Act imposes various obligations on parties and entities it governs. For instance, developers must submit detailed proposals outlining potential environmental impacts and mitigation measures. Companies like Coogee Energy Pty Ltd and Moolarben Coal Operations Pty Ltd must ensure their projects comply with the Act’s requirements, including conducting thorough environmental impact assessments. They are also required to submit these assessments to the relevant authorities for review. Additionally, entities must adhere to any conditions imposed upon their approval to mitigate adverse environmental effects. Failure to comply with these obligations can lead to legal consequences. The EPBC Act also establishes offences, penalties, and consequences for non-compliance. Under Section 133, actions approved with conditions must comply with those conditions; otherwise, they may face legal repercussions. For example, if Venture Minerals fails to adhere to the conditions set for its DSO Hematite Mine, it could be subject to enforcement actions. Similarly, if public notifications regarding referrals for approval are missed or not met within the required timeframes, the Department of Sustainability, Environment, Water, Population and Communities will notify these even if the timeframe has lapsed. The Act includes provisions for penalties and enforcement measures to ensure compliance. Although late notifications do not affect the subsequent processing of referrals or decisions made, they highlight the importance of adhering to the Act’s requirements to avoid any legal complications.
