Key Provisions

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) (sections 75, 87, 133, and 143) outlines the requirements for environmental impact assessments and approvals for certain actions, and provides for the variation of conditions of approval. Certain actions require approval (sections 75) if they are deemed likely to have a significant impact on matters of national environmental significance. For instance, failure to comply with the requirements for approval, notification, assessment, or conditions of approval can result in civil or criminal penalties. The maximum penalties for offences under the Act include fines of up to $1.1 million for individuals and $5.5 million for corporations, as well as imprisonment for up to five years. Additionally, the Act provides for the recovery of costs incurred by the Department in relation to the assessment and approval of actions. Furthermore, the Act allows for the imposition of conditions in approval decisions to mitigate any potential environmental impacts of the action. Finally, the Act provides for the public notification of decisions and the reasons for those decisions, ensuring transparency and accountability in the environmental approval process.
