Some public notifications on the Internet and in the Gazette relating to the processing of referrals for approval under Chapter 4 of the Environment Protection and Biodiversity Conservation Act 1999 may occasionally be missed in processing by the Department of the Environment and Energy or may not meet timeframes for notification. The Department of the Environment and Energy has implemented systems and ongoing quality assurance procedures to minimise any risk of missing a notification within the required timeframe. Where a missed notification is identified the practice will be to notify these even though the timeframe for notification has lapsed. This will ensure that the history of notifications for each referral is available to the public. The Department of the Environment and Energy regrets any inconvenience that may be caused by a missed notification. Please note that late notifications have not affected subsequent processing of referrals or assessments and they do not affect decisions made.
Overview
The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) was enacted to provide for the protection of the environment, particularly matters of national environmental significance, by establishing a framework for the assessment and approval of actions that may have a significant environmental impact. This Act aims to ensure that the Commonwealth Government considers environmental impacts in its decision-making processes. The EPBC Act was established by the Commonwealth Parliament and is administered by the Department of the Environment and Energy. The primary policy objective of the Act is to protect and manage Australia's biodiversity and environment through a cooperative approach involving both the Commonwealth and state governments, as well as the community and industry. The Act seeks to balance environmental protection with economic and social considerations, ensuring sustainable development and conservation of the nation's natural heritage.
Scope and Application
The Environment Protection and Biodiversity Conservation Act 1999 applies to actions that may impact on matters of national environmental significance, such as listed threatened species and communities, within Australia. The Act applies to both individuals and entities, including companies, local governments, and other organisations, when they undertake actions that may have significant environmental impacts. The Act’s jurisdictional reach is national, meaning it applies across all states and territories of Australia. The Act includes provisions for exemptions and thresholds for certain actions, and these can be further defined through subordinate instruments. Where an action is determined to require approval under the Act, the relevant provisions are sections 18 and 18A, which pertain to listed threatened species and communities. In instances where actions do not require approval, the Act provides for this determination under section 75. The Act also provides for assessment approaches and decisions on approvals, which can include conditions, under sections 87 and 133 respectively.
Key Provisions
The Environment Protection and Biodiversity Conservation Act 1999 (the "EPBC Act") is pivotal in governing actions that may impact the environment, including actions involving listed threatened species and communities. Section 75 of the Act specifies certain actions that require approval, such as those involving residential or commercial developments near areas known to contain listed threatened species or communities (sections 18 and 18A). The Act delineates a structured assessment process as per section 87, which may involve preliminary documentation or referrals for detailed evaluations. Decisions on approvals are rendered under section 133, often accompanied by conditions to mitigate environmental impacts.
The EPBC Act imposes specific obligations on parties or entities conducting actions that may affect the environment. These obligations include notifying the Department of the Environment and Energy about proposed actions, providing detailed documentation, and complying with any conditions set by the Minister for the Environment. The Act mandates that developers and other entities must assess the potential impact of their actions on listed threatened species and communities and take necessary measures to avoid, mitigate, or offset such impacts. Failure to comply with these obligations can result in legal consequences, including the potential for the Minister to take enforcement actions.
Under the EPBC Act, breaches of its provisions can lead to severe penalties. For instance, civil penalties can be imposed for non-compliance with the Act, with maximum penalties reaching up to $666,000 for individuals and $3.33 million for corporations, as stipulated in section 528. Criminal penalties may also apply, with fines and imprisonment for serious or repeated offences. The Act provides a framework for the enforcement of these penalties, ensuring that those who harm the environment are held accountable. The seriousness of the breach and the extent of the environmental damage are key factors in determining the appropriate penalty.
