This federal Act applies to individuals, companies, and other entities undertaking actions that fall within its scope, such as mining projects, renewable and non-renewable energy developments, waste management facilities, and infrastructure projects. The Act's jurisdiction extends across Australia, including Commonwealth marine areas, and it is enforced by the Department of the Environment. The Act includes provisions for the approval, assessment, and regulation of actions deemed to have a significant impact on protected matters. There are also exclusions and exemptions, such as certain agricultural activities, that may reduce the scope of application. The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) is a comprehensive piece of legislation that aims to protect and conserve Australia's environment, including its biodiversity and heritage, both within and beyond its borders. Under the EPBC Act, certain actions are determined as requiring approval (sections 75), while others are not (sections 75). For example, the proposed Jupiter Wind Farm project in Tarago, NSW, and the proposed Glenfield Waste Services recycling facility in Glenfield, NSW, are actions determined as requiring approval due to their potential impact on listed threatened species and communities (sections 18 and 18A). In contrast, the culvert replacement and reno mattresses installation project in South Nowra, NSW, and the construction of a western access road in Julago, QLD, are actions determined as not requiring approval. The Act also provides for the assessment of actions (section 87) and the variation of conditions of approval (section 143) for projects that have already been approved. The EPBC Act imposes several obligations and requirements on the parties or entities it governs. In addition, the Act requires proponents to provide public notifications on the Internet and in the Gazette relating to the processing of referrals for approval under Chapter 4 of the EPBC Act. The Department of the Environment has implemented systems and ongoing quality assurance procedures to minimise any risk of missing a notification within the required timeframe. The EPBC Act also includes provisions for offences, penalties, and civil/criminal consequences for breach. For example, a person who contravenes a condition of an approval or a direction given by the Minister under the Act may be subject to a civil penalty of up to $666,000 for a corporation and $133,000 for an individual, or imprisonment for up to two years, or both. In addition, a person who causes harm to a listed threatened species or community may be subject to a criminal offence and a fine of up to $222,000 for a corporation and $44,000 for an individual. The Act also provides for the recovery of costs incurred by the Department of the Environment in assessing an application or monitoring an approved action. It is important for parties and entities governed by the EPBC Act to comply with its provisions to avoid any potential legal or financial consequences.
