Some public notifications on the Internet and in the Gazette relating to the processing of referrals for approval under Chapter 4 of the Environment Protection and Biodiversity Conservation Act 1999 may occasionally be missed in processing by the Department of the Environment or may not meet timeframes for notification. The Department of the Environment has implemented systems and ongoing quality assurance procedures to minimise any risk of missing a notification within the required timeframe. Where a missed notification is identified the practice will be to notify these even though the timeframe for notification has lapsed. This will ensure that the history of notifications for each referral is available to the public. The Department of the Environment regrets any inconvenience that may be caused by a missed notification. Please note that late notifications have not affected subsequent processing of referrals or assessments and they do not affect decisions made.

 

Overview

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) was enacted to provide for the protection of the environment, particularly matters of national environmental significance, by establishing a framework for the assessment and approval of certain actions that may impact the environment. The Act was introduced to address the need for a unified national approach to environmental protection, ensuring that environmental considerations are integrated into decision-making processes at both federal and state levels. Enacted by the Australian Parliament, the policy objective of the Act is to safeguard the environment by preventing significant detrimental impacts from proposed actions, particularly those that may affect areas of national environmental importance such as listed threatened species and ecological communities, World Heritage properties, and other significant natural features. The Act operates alongside state and territory environmental laws to provide a comprehensive environmental protection regime. The EPBC Act outlines various processes for the assessment and approval of actions that may have significant environmental impacts, including the requirement for public notifications and opportunities for public comment on proposed actions. The Act also includes provisions for the variation of conditions of approval for previously assessed actions, allowing for adjustments to be made in response to new information or changing circumstances. Despite the Department of the Environment's efforts to ensure timely and accurate notifications, instances of missed or delayed notifications may occasionally occur, though these do not affect the substantive assessment and decision-making processes under the Act.

Scope and Application

The Environment Protection and Biodiversity Conservation Act 1999 applies to a wide range of entities and actions across Australia, aiming to protect and manage the environment, including matters of national environmental significance such as listed threatened species and communities, Commonwealth land, and matters with a international environmental significance. The Act applies to various industries and activities, including mining, commercial development, water management, residential development, and energy generation, ensuring that these activities are assessed for their potential environmental impact. The geographical scope of the Act is national, covering the entire Commonwealth of Australia, including territories. The Act can extend its application through subordinate instruments, which can provide additional details on specific actions or industries. There are certain exclusions and exemptions outlined in the Act, such as actions that have already been assessed under other legislation or those that are considered to have minimal environmental impact. The Department of the Environment maintains a list of referrals for approval under the Act, ensuring transparency and public access to information on environmental assessments and decisions.

Key Provisions

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) governs several critical actions under sections 75, 87, 130(4), and 143. Section 75 specifies actions requiring approval, such as the redesign and reconfiguration of the Northern Overburden Emplacement Facility at McArthur River Mine (reference 2014/7210) and the construction of road and services infrastructure at Essendon Airport (reference 2014/7213). Section 87 outlines the assessment approach for these actions, including accredited assessments and preliminary documentation. Section 130(4) addresses the extension of time for certain projects, like the Carmichael Coal Mine and Rail Project by Adani Mining (reference 2010/5736). Section 143 pertains to the variation of conditions of approval for various projects, including the Port Hedland Outer Harbour Development by BHP Billiton Iron Ore (reference 2008/4159) and the Newlands Coal Extension Project by Xstrata Coal Queensland Pty Ltd (reference 2011/5968). The Act imposes specific obligations and requirements on parties and entities. For projects requiring approval, entities must submit detailed proposals, including environmental impact assessments, to the Department of the Environment. These proposals must comply with the EPBC Act and any relevant state or territory legislation. Accredited assessments and preliminary documentation must also be submitted for review. For projects where conditions of approval have been varied, the entity must adhere to the new conditions and report any changes to the Department of the Environment. Additionally, entities must ensure that their actions do not harm listed threatened species and communities (sections 18 and 18A) and comply with any requirements related to Commonwealth land (sections 26 and 27A). Failure to comply with the EPBC Act can result in various civil and criminal consequences. For example, unauthorised actions that harm listed threatened species and communities can lead to substantial fines, with maximum penalties reaching up to AUD 1.1 million for individuals and AUD 5.5 million for corporations. Similarly, unauthorised actions on Commonwealth land can incur fines of up to AUD 1.1 million for individuals and AUD 5.5 million for corporations. The Act also allows for the imposition of injunctions and other remedies to prevent or rectify non-compliance. In cases where a missed notification is identified, the Department of the Environment will notify the public, although this does not affect subsequent processing or decision-making.
