IT IS HEREBY NOTIFIED for general information that His Excellency the Governor-General, in the name of Her Majesty, assented on 16 May 2021 to the undermentioned Act passed by the Senate and the House of Representatives in Parliament assembled, viz:

Overview

Scope and Application

This Act applies to all Commonwealth public sector agencies, including government departments, statutory authorities, and other entities under the Commonwealth’s purview. It also extends to individuals and entities seeking access to information under the Freedom of Information Act, as well as those responsible for the management and preservation of public records under the Archives Act. The geographic reach of the Act is national, applying uniformly across all states and territories of Australia, thereby ensuring a standardised approach to the governance of public information and archival records. There are no specific exclusions or exemptions outlined in the Act itself, but it is noted that the application of certain provisions may be further defined or restricted through subordinate instruments, such as regulations or guidelines issued under the authority of the Act. These subordinate instruments may provide additional detail or clarification on the scope and implementation of the amendments introduced by the Act.

Key Provisions

The Archives and Other Legislation Amendment Act 2021 introduces significant changes to the Archives Act 1983 and the Freedom of Information Act 1982. Key provisions include amendments to the record-keeping obligations for Commonwealth agencies (Sections 2 and 3). These sections mandate that agencies must now retain and manage their records in accordance with prescribed standards and practices, ensuring that records are appropriately identified, classified, and preserved for future access and reference. Under these new requirements, agencies must establish and maintain a comprehensive records management framework that aligns with the standards set out in the Archives Act. This includes the development of records schedules that detail the retention and disposal periods for various types of records (Section 4). Agencies are also required to implement policies and procedures that support effective records management practices, ensuring that records are accessible, secure, and properly managed throughout their lifecycle. The Act imposes obligations on Commonwealth agencies to ensure compliance with these new record-keeping requirements. This includes appointing a records officer responsible for overseeing the agency's records management program and ensuring adherence to the prescribed standards (Section 5). Agencies must also provide training and support to staff to ensure they understand their roles and responsibilities in managing records effectively. Breach of the provisions under the Archives and Other Legislation Amendment Act 2021 can result in significant consequences. Non-compliance with the record-keeping requirements may lead to civil penalties, including fines of up to $10,000 for individuals and $50,000 for bodies corporate (Section 10). In cases of serious or repeated breaches, agencies may also face additional administrative penalties or even criminal charges, with potential maximum penalties of up to $210,000 for bodies corporate and imprisonment for up to two years for individuals (Section 11). The Act also provides for the recovery of costs incurred by the Archives in relation to non-compliance, further emphasising the importance of adherence to the legislative requirements.
