The court found that the nature of the applicant's rights under Part VII of the 1996 Act, and in particular the absence of an individual economic right, meant that the duty did not give rise to a civil right. The court further held that the absence of a full fact-finding jurisdiction in the county court did not deprive it of what it needed to satisfy the requirements of article 6(1). The appeals were subsequently dismissed.
