The Court of Appeal also concluded that the High Court judge had rigorously examined the evidence, and that the consistent evidence of the experts was sufficient for the judge to conclude that Mr Togia was fit to stand trial.

The Supreme Court held that the Court of Appeal's decision on the question of whether Mr Togia was in custody at the time the report was ordered was clearly correct. The Court also held that the Court of Appeal's decision on the question of whether the High Court judge had rigorously examined the evidence was in any event clearly correct. The Supreme Court therefore dismissed the application for leave to appeal.
