CaseChat Overview and Summary
Miles McKelvy was convicted of 27 charges of dishonesty offences and sentenced to eight years imprisonment with a minimum non-parole period of five years. He appealed the sentence on the basis that it was manifestly excessive. The Court of Appeal held that the sentencing Judge had correctly determined a starting point of 10 years imprisonment, appropriately accounted for personal aggravating factors by adding two years, and gave sufficient credit for the appellant's early guilty pleas. The Court also found that the five-year minimum non-parole period was not manifestly excessive given the seriousness of the offending. The appeal against sentence was dismissed.
