R v Hadfield CA337/06

The case of R v Hadfield CA337/06 involved Warren Robert Hadfield, who appealed against his six-year imprisonment sentence for importing 800g of pure methamphetamine into New Zealand. Hadfield had assisted authorities in apprehending four other individuals involved in the importation, leading to their arrest and the seizure of $306,000. Hadfield's appeal, based on his additional assistance to authorities post-sentencing, raised two primary issues. The Court of Appeal recommended that sentencing judges consider both past and promised future assistance to authorities when determining a sentence, overruling previous suggestions that future assistance should not be factored in. This approach reduces the risk of offenders tailoring their evidence to secure a larger discount on appeal and makes the sentencing process more efficient. The court also suggested that sentencing judges should record their reasoning on assistance and any discounts in a separate, confidential memo to ensure the Court of Appeal is fully informed in case of an appeal. As for the second issue, the court found that a 60% discount was appropriate for Hadfield's extensive assistance, resulting in a substituted sentence of four and a half years' imprisonment.
