NR v District Court at Auckland

The case of NR v District Court at Auckland involved multiple appeals and applications filed by NR, the appellant, against various decisions made by the District Court and High Court in relation to two proceedings. The first proceeding was a harassment proceeding brought by MR against NR, while the second was a civil proceeding brought by NR against MR. The District Court made a restraining order against NR in the harassment proceeding and struck out NR's statement of claim in the civil proceeding, leading to various appeals and applications being filed. The Court of Appeal heard seven interlocutory applications made in three of the appeals. The court allowed the applications for leave to appeal and cross-appeal, as well as the application for non-disclosure of MR's affidavit and the application to adduce further evidence in one of the appeals. The applications to strike out MR's affidavit, to invite the New Zealand Herald to explain an article, and to adduce further evidence in another appeal were dismissed. The court ordered costs to the successful party on the applications, with no order for costs on the application relating to the New Zealand Herald article and the application to adduce further evidence in the other appeal. The court also continued the order of the High Court that the names or any identifying particulars of NR and MR are suppressed from publication.
