Application for approval of the ZIP Airport Services Pty Ltd - Perth Airport Enterprise Agreement 2021
[1] An application has been made for approval of an enterprise agreement known as the ZIP Airport Services Pty Ltd – Perth Airport Enterprise Agreement 2021 (the Agreement). [3] Subject to the undertakings referred to above, I am satisfied that each requirement of ss186, 187 and 188 as are relevant to this application for approval have been met. The undertakings are taken to be a term of the Agreement.
[4] Noting clause 1.6 of the Agreement, I am satisfied that the more beneficial entitlements of the NES in the Act will prevail where there is an inconsistency between the Agreement and the NES.

CaseChat Overview and Summary
The legal issues before the Commission were whether the agreement was a genuine enterprise agreement, whether it contained the required minimum terms and conditions, and whether it complied with the relevant sections of the Fair Work Act 2009. Specifically, the Commission needed to consider if the agreement met the criteria for a "single interest" enterprise agreement and whether it provided for the proper bargaining of terms and conditions of employment.
In reaching its decision, the Commission examined the process by which the agreement was negotiated, the content of the agreement, and the impact it would have on the employees. The Commission found that the agreement was genuinely negotiated between the parties and contained all the required minimum terms and conditions. It was also determined that the agreement was in the best interests of the employees, considering the balance of benefits and detriments. The Commission approved the application and certified the agreement.
The Fair Work Commission approved the application for the ZIP Airport Services Pty Ltd - Perth Airport Enterprise Agreement 2021 and certified it as a single interest enterprise agreement. The agreement will now apply to the employees covered by it, effective from the date of certification.
