CaseChat Overview and Summary
The primary legal issues that the Commission had to address were whether the agreement was made in good faith, whether it contained the appropriate bargaining obligations, and whether the agreement was consistent with the relevant award and statutory minimum entitlements. Additionally, the Commission had to ensure that the agreement was made without coercion, undue influence, or misrepresentation, and that it was properly certified by an independent certifier.
In reaching its decision, the Fair Work Commission examined the evidence and submissions presented by both parties. The Commission found that the agreement was made in good faith and without any undue influence or coercion. It also determined that the agreement contained all the necessary bargaining obligations and complied with the relevant award and statutory minimum entitlements. Furthermore, the Commission confirmed that the agreement was properly certified and met the requirements for approval under the Fair Work Act 2009.
The Commission approved the Ziegam Enterprise Agreement 2013, finding that it was in the public interest and met all the legal requirements for approval. The decision was made on the basis that the agreement was fair and reasonable, and that it provided for the appropriate terms and conditions for employees covered by the agreement.
