The Administrative Appeals Tribunal considered an application for a Subclass 500 (Student) visa. The applicant, Ms Zhou, sought review of a decision concerning her eligibility for the visa. The central issue revolved around whether the applicant had satisfied the health insurance requirements for the visa.

The Tribunal was required to determine if the applicant had met the health insurance criterion for the Subclass 500 visa, specifically in light of new evidence presented to the Tribunal. This evidence took the form of a Policy Certificate of Overseas Student Cover.

The Tribunal found that the new evidence, a Policy Certificate of Overseas Student Cover for the period 28 March 2018 to 30 August 2018, demonstrated that the applicant had satisfied the relevant health insurance criterion. Consequently, the Tribunal remitted the application for reconsideration, directing that the applicant be found to meet the criteria for the visa, including cl.500.215 of Schedule 2 to the Regulations.
