Zhao (Migration)

The Administrative Appeals Tribunal considered an application by Ms Zhao for a Student (Temporary) (Class TU) visa, subclass 500. The dispute concerned whether Ms Zhao met the criteria for the visa.

The Tribunal was required to determine whether it could make a decision in favour of the applicant without a hearing, pursuant to section 360(2)(a) of the *Migration Act 1958* (Cth), and if so, what criteria for the Subclass 500 visa were met.

The Tribunal found that it was able to make a decision in favour of the applicant based on the material before it, and therefore a hearing was not necessary. The Tribunal remitted the application for reconsideration with a direction that the applicant meets the criteria specified in clause 500.211 of Schedule 2 to the *Migration Regulations 1994* (Cth).
