Zen and Jir and Anor

The application before Cronin J concerned a dispute between a wife and her husband, the respondent. The wife had filed an application on 9 July 2010, which was subsequently followed by orders made on 9 and 12 July 2010, restraining the husband from dealing with funds held in Citibank accounts in his name.

The central legal issue before the court was the wife's application to discontinue her proceedings and the consequential discharge of the interlocutory orders previously made.

Cronin J ordered that the wife's application filed on 9 July 2010 be marked as discontinued. Consequently, the restraining orders made on 9 and 12 July 2010, which prevented the husband from withdrawing or otherwise dealing with funds in his Citibank accounts, were discharged. The court also made no order for costs, and directed that the wife's solicitors serve a copy of these orders on the respondent husband and Citigroup Pty Limited. All proceedings were removed from the list of cases awaiting a hearing.
