CaseChat Overview and Summary

This matter concerned an application for a Student (Temporary) (Class TU) visa, subclass 500, made by Zeeshan. The applicant sought review of a decision not to grant the visa, which had been refused on the grounds that the applicant failed to satisfy Public Interest Criterion (PIC) 4020. The review was conducted by Senior Member Jennifer Cripps Watts of the Tribunal.

The central legal issue before the Tribunal was whether the applicant had provided a "bogus document" in relation to their visa application, thereby failing to meet PIC 4020(1). This criterion requires that there be no evidence that the applicant has given, or caused to be given, a bogus document or false or misleading information in relation to the application or a previous visa. The Tribunal was also required to consider whether any of the requirements of PIC 4020 could be waived due to compassionate or compelling circumstances.

The Tribunal reasoned that the applicant had provided a certificate of deposit from a bank in their home country, which departmental checks identified as a "ghost bank." The definition of a bogus document under section 5(1) of the Migration Act 1958 includes a document that purports to have been issued but was not, or was obtained because of a false or misleading statement. The Tribunal found that the certificate was a bogus document, and that the applicant had therefore failed to satisfy PIC 4020(1). The Tribunal noted that the applicant's subsequent provision of a certificate from a different bank, or the amount of funds in an Australian account, were not material to the issue of the bogus document. Furthermore, the Tribunal found no compassionate or compelling circumstances that would justify waiving the PIC 4020 requirements.

Consequently, the Tribunal affirmed the decision not to grant the applicant the Student (Temporary) (Class TU) visa.
