Zaharuiko v Public Trustee

The applicant, Zaharuiko, appealed to the Supreme Court of South Australia against a decision of the Public Trustee. The nature of the dispute concerned the administration and financial management of a person with impaired capacity.

The court was required to determine whether the applicant's grounds of appeal and interlocutory application had any reasonable prospect of success, and whether permission to appeal or interlocutory relief should be granted.

Acting Livesey Ex Tempore CJ found that none of the matters raised in the notice of appeal or the interlocutory appeal had any reasonable prospect of succeeding. Consequently, the court concluded that permission to appeal would not be given and interlocutory relief would not be granted.

The appeal and the interlocutory application were therefore summarily dismissed, with the applicant ordered to pay the respondent's costs fixed at $500 within 14 days.
