Yen and Yin

In the matter of *Yen and Yin*, Cronin J made orders concerning the division of property and the resolution of financial matters between the parties. The dispute involved the transfer of shares in B Pty Ltd and C Pty Ltd, the assignment of powers and entitlements within the Yin Family Trust, and the allocation of other assets and liabilities.

The court was required to determine how the parties' financial interests in various companies and a trust should be divided, and to make orders for the transfer of property and the assumption of liabilities. The court also needed to address the issue of costs and the method of service of court documents on the respondent husband.

Cronin J ordered the husband to transfer all his shares in B Pty Ltd and C Pty Ltd to the wife, and to authorize the registration of these transfers. He was also required to resign from any positions held in these companies and to assign his powers and any credit amounts in the Yin Family Trust to the wife, as well as to disclaim all rights under the Trust Deed. The wife was ordered to meet the debts and liabilities of the companies and the trust from a specified date and to indemnify the husband against any such liabilities, with an exception for the husband's taxation liabilities. The court also made provision for the Registrar to execute documents on the husband's behalf if he failed to comply with the orders, and specified that other property, including joint bank accounts and superannuation, would be divided as detailed in the orders. The husband was ordered to pay the wife's costs.
