Yaputra (Migration)

The Administrative Appeals Tribunal considered an application for a Subclass 500 (Student) visa by Richard Yaputra. The dispute concerned whether Mr Yaputra had provided sufficient evidence of Overseas Student Cover as required by the relevant regulations.

The Tribunal was required to determine whether the applicant had satisfied the criterion set out in cl.500.215 of Schedule 2 to the Regulations, which pertains to the provision of adequate overseas student health cover.

The Tribunal found that a Policy Certificate issued by Allianz Global Assistance on 8 September 2017, which provided cover for Mr Yaputra from 3 September 2017 until 3 May 2020, constituted sufficient evidence. In light of this new evidence, the Tribunal concluded that the criterion was met and therefore remitted the application for reconsideration with a direction that the applicant satisfies the relevant visa criteria.
