Yalpat and Yalpat (No 4)

In *Yalpat and Yalpat (No 4)*, Gill J of the Family Court of Australia considered an application by the Father for orders regarding his time with the child, and a subsequent application by the Mother for summary dismissal of the Father's case.

The central legal issue before the court was whether the Father's Amended Application in a Case, filed on 26 November 2019, should be summarily dismissed. This required the court to assess if the Father's application had any reasonable prospect of success.

Gill J dismissed the Father's application, finding that it lacked a reasonable prospect of success. The court reserved the Mother's application for costs to the final hearing, allowing for consideration of the criteria set out in section 117 of the relevant legislation.
