Y Firm and Sands

In the matter of Y Firm and Mr Sands, the dispute concerned the costs incurred by Y Firm in complying with a subpoena and the costs of proceedings initiated by Mr Sands's Notice of Objection. The decision was made by Loughnan JR.

The court was required to determine the quantum of costs payable by Mr Sands to Y Firm for their compliance with a subpoena issued on 20 October 2006. Additionally, the court had to consider the basis upon which Mr Sands should pay Y Firm's costs associated with the Notice of Objection filed on 19 December 2006, and the fate of a Response to an Application in a Case filed by Mr Sands on 20 February 2007.

Loughnan JR ordered that Mr Sands pay Y Firm the sum of $32,452.66 within 14 days for their costs of complying with the subpoena. Furthermore, Mr Sands was ordered to pay Y Firm's costs of and incidental to the proceedings commenced by the Notice of Objection on an indemnity basis, with these costs to be agreed or assessed. The Response to an Application in a Case filed on behalf of Mr Sands was dismissed.
