XUE (Migration)

The applicant, XUE, sought review of a decision concerning an application for a Skilled (Residence) (Class VB) visa, Subclass 886 (Skilled – Sponsored). The matter came before the Tribunal.

The primary legal issue before the Tribunal was whether the applicant met the criteria for the visa, specifically in relation to character requirements under Public Interest Criterion 4001, and whether the Department of Home Affairs was best placed to conduct further inquiries concerning these requirements.

The Tribunal noted that the applicant had provided current Australian and Chinese police certificates, which indicated no criminal convictions. However, the Tribunal considered that other factors might be relevant to the assessment of PIC 4001. Consequently, the Tribunal determined that the Department was best positioned to undertake the necessary inquiries.

The Tribunal remitted the application for reconsideration, with a direction that the applicant be taken to meet the criteria specified in cl. 886.222(3)(a) of Schedule 2 to the Regulations.
