Xin and Qinlang & Ors

In the matter of *Xin and Qinlang & Ors*, Gill J considered an application to join parties to proceedings and to grant a stay on an earlier court order. The applicant, referred to as the Wife, and the respondents, referred to as the Husband, were involved in a dispute. The proposed Third Party Respondent 1 (Mr C) and Third Party Respondent 2 (Mr B) sought to be joined to the proceedings.

The primary legal issues before the court were whether to permit the joinder of Mr C and Mr B as third parties, and whether to grant a stay on the operation of Order 5(a) of previous orders made by Judge Hughes on 24 February 2020. The court also had to consider the terms upon which any such stay would be granted, including the requirement for an undertaking as to damages.

Gill J ordered that Mr C and Mr B be joined as Third Party Respondents, notwithstanding any noncompliance with court rules, and without opposition. A stay was granted on Order 5(a) of the 24 February 2020 orders, to continue until the further hearing on 19 May 2020, conditional upon the Second and Third Respondents filing an undertaking as to damages. The proceedings were adjourned for further hearing, with costs reserved. Directions were given for the filing of applications, affidavits, and documents outlining the factual and legal basis for asserted interests in property, and for affidavit material relating to the stay and disposition of property.
