On 13 December 2023, the Tribunal set aside the primary decision and substituted it with a decision approving the nomination. Furthermore, K.P.D.O. Pty Ltd was confirmed to be an approved work sponsor, with its approval valid until 29 September 2025. Consequently, the Tribunal found that the cumulative requirements of clause 482.212(1) were now met.

Given these findings, the Tribunal determined that the appropriate course of action was to remit the matter to the Minister for reconsideration of the remaining visa criteria. The Tribunal directed that the applicant be considered to meet the criteria under clause 482.212(1) of Schedule 2 to the Regulations.
