CaseChat Overview and Summary
The legal issues before the Commission involved whether the agreement contained the appropriate minimum terms and conditions as specified in the Act, and whether the agreement was made in good faith and without coercion. Additionally, the Commission had to consider if the agreement was likely to have a positive effect on workplace relations by promoting higher wages and better working conditions.
The Commission found that the agreement contained the required minimum terms and conditions, and that it was made in good faith. The Commission also determined that the agreement was likely to have a positive effect on workplace relations by promoting higher wages and better working conditions. Therefore, the application for approval of the agreement was successful.
The Fair Work Commission approved the Woolworths 360 (WA Service and Install) Enterprise Agreement 2024, effective from the date of the decision. The agreement now provides the basis for the terms and conditions of employment for the relevant employees in Western Australia.
